"We are witness to what has become known as "Mumia Law," as opposed
to U.S. law, said Mackler. "No matter what the present law and
precedents are, the courts find ways to circumvent them with spurious
arguments that expose the political nature of Mumia's prosecution and persecution. The State of Pennsylvania wants Mumia murdered and they couldn't care less about what laws and precedents stand in their way."

Last week’s court decision was not a victory. While we obviously prefer to have Mumia alive, instead of executed, life in prison without parole is an unacceptable sentence for an innocent man that was convicted with a blatantly unfair trial.

While ruling against the three issues that could have led to a new guilt-phase trial, the court affirmed Judge Yohn's 2001 decision overturning the death sentence. If the District Attorney wants to re-instate the death sentence, the DA must call for a new penalty-phase jury trial that would be limited to the question of life in prison without a chance of parole or a death sentence. See responses from Pam Africa, lead attorney Robert R. Bryan (on Democracy Now!), and articles by the Philadelphia Inquirer (w/ special archive page), David Lindorff, Linn Washington Jr., and The German Network Against the Death Penalty and to Free Mumia.

Protest actions are planned for Friday, March 28, in New York City, and San Francisco. In Philadelphia a press conference and emergency planning meeting are scheduled for Monday, March 31, as well as a mass demonstration on April 19, the Saturday before the Presidential Primary Election in Pennsylvania. Abu-Jamal's friends, The MOVE 9, have parole interviews in early April. At a PA State Capitol press conference this week (WATCH VIDEOS), supporters publicized the campaign to contact the Parole Board and sign an online petition.

Following Thursday's court ruling, Mumia Abu-Jamal's lead attorney, Robert R. Bryan, responded in an interview with "Journalists for Mumia Abu-Jamal." The full text is below.

The March 27 decision by the 3rd Circuit Court marks a sad day not only in the struggle for Mumia, but also in the general struggle for the rights of defendants in court and for civil and human rights.

After spending almost a year’s time deliberating following a hearing last May 17, a three-judge panel of the Third Circuit Court of Appeals in Philadelphia has shot down all three claims by death row prisoner Mumia Abu-Jamal challenging his conviction for the 1981 murder of Philadelphia Police Officer Daniel Faulkner.

Third Circuit Court Rules Against a New Trial For Mumia!

While ruling against the three issues that could have led to a new trial, the court affirmed Judge Yohn's 2001 decision overturning the death sentence. If the District Attorney wants to re-instate the death sentence, the DA can now call for a new penalty-phase jury trial that would be limited to the question of life or death.

Protest actions are planned for Friday (3/28), including in New York City at The Adam Clayton Powell State Office Building (125th St. and Adam Clayton Powell Jr Blvd.) at 5pm, and in San Francisco. For the latest updates, go to www.freemumia.com

And while we can see how such truths might cause discomfort to American nationalists, can we not also agree that they are truths? Consider, would Sen. Clinton be where she is if she were born in a Black female body? Or if she were born to a single mother in the projects? As for the nation, it may be too simplistic to say it was built on racism, but was surely built on racial slavery, from which its wealth was built. And who runs America, if not the super rich white elites? Who doesn't know that politicians are puppets of corporate and inherited wealth?
