Third Circut Court of Appeals hears Mumia Appeal and District Attorney Counter Appeal

by

The Third Circut Court of Appeals heard the appeal of Mumia Abu Jamal and the counter appeal of the District Attorney yesterday. Press Conference Audio Attached.

The Third Circut Court of Appeals heard the appeal of Mumia Abu Jamal and the counter appeal of the District Attorney. The process began with the prosecution explaining why Mumia should not be allowed a new trial due to lack of legal precedents. He discussed mainly the cases of Banks, Zettlemoyer, Albrackt, Mills and Void. He also discussed Holloway and Ford. The judges had a thorough understanding of these cases and seemed well prepared, grilling both sides with serious and detailed questions. The prosecution suggested that because there was no legal precedent, the suggestion to keep Mumia on death row is valid -- a weak arguement at best. Both the prosecution and the defense spent a significant amount of time discussing the racial bias of the '81 prosecution and that two thirds of the jury exemptions (potential jurors that can be eliminated without cause) were black. It seemed that the appeal of the defense is hanging on the judges deciding there was prejudice during both jury selection and the during the trial.

Mumia shouldn't have killed Danny Faulkner. He doesn't belong in a 6X8 cell, he belongs six feet closer to HELL!!
